Application Terms and Conditions

1.These Terms

These Application Terms and Conditions set out information about the services we provide and how we provide them, including any fees we charge. They form part of the Agreement between us.

Our services are provided in accordance with these terms and conditions (referred to as Application Terms and Conditions) and in accordance with our Privacy Policy and the terms of use set out in Disclaimer and Important Information (together “the Agreement”). These documents and other information that may be relevant to our services and what we do, are all available on our website under TRUST CENTRE.

 

We may amend our Application Terms and Conditions from time to time, but in the event such changes materially and detrimentally affect your rights or obligations we will notify you and you will have a reasonable opportunity to terminate the Agreement before the changes take effect.

 

Some words and expressions we use have particular meanings. Usually these will begin with a capital letter. The meanings of these words and expressions are explained in the glossary at the end of this document. You should refer to the glossary to make sure you fully understand how we use a word or expression.

 

You accept these Application Terms and Conditions when you submit your Application to us.

2.Services

Money Supply Limited is a broking business. Its business is to assist customers seeking vehicle finance to identify available finance options.

 

We also assist in sourcing insurance policies related to motor vehicles, such as mechanical insurance.

 

We do not provide personal advice services and we do not make any recommendation in respect of any credit offer or insurance product.

 

We may, in our sole discretion, decline your Application in which event we have not provided you with any services.

3.Process

To access our services, you must:

 

  • Be permanently resident in New Zealand
  • Over 18 years of age
  • Hold a valid New Zealand Driver Licence
  • Have a regular income.

 

You must complete in full and submit our Application form (available on our website).

When we receive your Application we will assess the information you have provided and whether you meet the eligibility requirements of the available Providers. We will advise you of the outcome of this process and whether your Application has been accepted by us to make credit applications on your behalf.

 

If we accept the Application, we will review, collate and where necessary obtain additional information from yourself and/or third parties and use all the information we have to make applications for credit on your behalf.

 

Acceptance of the Application is not an assurance or guarantee that any application for credit will be accepted or that you will be offered any loan or insurance products.

4.Relationship

The submission of the Application does not constitute an agreement between us. We, in our sole discretion, will review and assess the Application and advise you of our acceptance or otherwise.

When you submit the Application, subject to our acceptance above, you appoint us as your agent to make applications for credit (and where relevant, insurance) to Providers.

You authorise us to assess the information provided, including your personal circumstances and objectives, in order to match your credit requirements with Providers most likely to offer the best terms and competitive rates for your situation. You also authorise us to undertake any credit, verification or other checks required in relation to the Application. You agree that we collect, use, share and store personal information that you provide in accordance with our Privacy Policy and you authorise third parties to release all relevant requested information to us in accordance with our Privacy Policy as required.

 

We do not provide financial advice. In the event a Provider offers credit, we will not make any recommendation about the terms of the offer or whether you should accept or decline the offer.

 

Similarly, we do not make recommendations as to the value, suitability or appropriateness of any insurance policies although we will source insurance options for you to consider.

5.Insurance Policies

A creditor may require that you have particular insurance in place in respect of any vehicle that you purchase, as the vehicle will in almost all instances be security under the loan.

 

We are able to apply for insurances on your behalf, including mechanical breakdown insurance and GAP insurance. We will assess your eligibility for such policies and advise you of the terms of the policies as provided by the relevant Provider. We will not make recommendations on the affordability, suitability or otherwise of any insurance product.

6.Your Obligations and Acknowledgements

You must, and agree to, provide all information we reasonably request in order to make any applications to Providers and to respond to any requests by Providers for any additional information.

 

You warrant and agree that all information that you provide is true, accurate, complete and up to date and that you have not omitted any information that may impact any decision making by us or any Provider.

 

You must advise us of any change in circumstances that occurs, or you become aware will occur, and that may impact your personal circumstances during the course of our relationship.

 

You acknowledge and accept that we are not required to verify any information you provide to us and which we pass on to a Provider and where we do undertake any independent enquiries, we do not confirm the accuracy or completeness of such enquiries.

 

You acknowledge we do not accept responsibility or liability to you for any loss you may suffer in connection with a lack of information, or inaccurate, untrue or incomplete information being provided by you or on your behalf, to us, a Provider or any other person and we not do we give any assurance or undertaking that you will be able to obtain a loan or insurance policies through our services.

7.Termination

You may withdraw the Application at any time without cause by notifying us in writing (email us at hey@moneysupply.co.nz). The termination will take effect seven days from receipt of the termination notice.

 

Where you withdraw the Application prior to any applications to Providers being made, we will stop any work including any enquiries we were conducting and the Agreement will be considered terminated. You will not be liable for any fees.

 

Where we have already made applications to Providers, we will not make any additional applications, but we will be entitled to all applicable fees in the event you subsequently enter into a loan with one of the Providers to whom we made an application on your behalf.

 

We may terminate the Agreement at any time without cause by providing you with seven days’ written notice of our intention to terminate. We may also terminate with cause at any time without notice.

 

Termination does not impact the payment of any fees that may be charged or that have been charged and are outstanding. Fees may also accrue in the event a loan is entered following termination as a consequence of services previously provided by Money Supply Limited.

8.Fees

We charge a Platform Fee for our services. The fee is charged where you enter into a loan that we have arranged or as a consequence of the services we have provided.

 

The Platform Fee charged is $500 although in our sole discretion we may determine to charge a lesser sum than that.

You acknowledge and agree that unless otherwise specifically agreed and arranged, the Platform Fee will be added to the loan amount and that it will be paid to Money Supply Limited directly by the relevant Provider upon drawdown of the loan.

 

We may waive a Platform Fee in our sole discretion.

9.Commission

We may receive a commission from Providers where you enter a loan or purchase an insurance policy through use of our services. The amount will vary among Providers.

 

We make applications on your behalf to all Providers where you meet the eligibility requirements and do not provide advice or recommendations to you about any loan or insurance options. This eliminates any potential conflict of interest.

 

We do not accept incentives from any Provider to prioritise applications to them ahead of other Providers.

10.General Provisions

The Agreement commences when we advise you that we have accepted your Application.

 

Our services are provided only to you, the person named in the Application and who accepts these Application Terms and Conditions. You may not assign or transfer any of your rights or obligations under the Agreement except with our written consent.

Glossary

Agreement means these Application Terms and Conditions, our Privacy Policy and our Disclaimer and Important Information document.

 

Application means the application process we have in place on our website to access our services and provide information to enable us to apply on your behalf for a loan and/or insurance policy.

 

Disclaimer and Important Information refers to the about liabilities, warranties and limitations on the services provided as set out on our website.

 

Platform Fee means the fee we charge for our services as set out in section 8 above.

 

Privacy Policy means our privacy policy published on our website.

 

Provider means a lender/creditor or an insurer who offers loan or insurance products and to whom we may make applications for such products/services on your behalf.

 

We, us and our refers to Money Supply Limited.

 

Website refers to our website at www.moneysupply.co.nz.

 

You or your refers to the person named on the Application.
